A Canadian work permit is a legal authorization that allows a foreign national to work temporarily in Canada. While it is not the same as permanent residence, a work permit enables individuals to gain Canadian employment experience, support themselves and their families, and in many cases, pursue a pathway to permanent residency.

Types of Work Permits

There are two main categories:

1. Employer-Specific Work Permits: Tied to a single employer, location, and job role. Often requires a Labour Market Impact Assessment (LMIA), unless exempt. LMIA-exempt roles may still require the employer to submit a job offer through IRCC’s Employer Portal.

2. Open Work Permits: Allows employment with any eligible Canadian employer. Available in specific scenarios such as Post-Graduation Work Permit (PGWP), spouses of workers or students, vulnerable workers, or those in humanitarian situations.

Eligibility Requirements

To qualify, applicants generally must:
– Prove intent to leave Canada when the permit expires
– Show sufficient financial resources
– Have no serious criminal record
– Be in good health (medical exam may be needed)
– Submit all required supporting documentation

Employer-Specific Work Permits

These permits are job-specific and list the employer, job title, and work location. If the worker wants to change jobs, they must apply for a new work permit. Many roles require a valid LMIA to prove that hiring a foreign worker will not harm the Canadian labor market. Even in LMIA-exempt cases, employers may need to submit an employment offer through the Employer Portal.

Open Work Permits

These are granted in limited situations:
– PGWP for international graduates
– Spouses of skilled workers or students
– Vulnerable workers escaping exploitation
– Certain family members of permanent residence applicants

They allow you to work for any eligible employer in Canada, offering flexibility without needing new permits when switching jobs.

Temporary Status and Renewal

Work permits are issued with a fixed expiry date. Extensions must be requested before the permit expires. In some cases, individuals may continue working under implied status while waiting for a decision. Failing to renew can lead to status loss and potential enforcement actions.
